Why a leading legal mind would rule in Novak Djokovic’s favour
One of Victoria’s most prominent legal minds says he’d likely find in Novak Djokovic’s favour, should he be presiding over the tennis star’s court hearing.
But David Galbally QC admits that decision could “open the floodgates” for COVID-19 exemptions in Australia.
Speaking on 3AW, Mr Galbally said Djokovic certainly had a case.
“I think I would probably rule in favour of Djokovic,” he said.
“The reason being, he has taken a whole series of steps – to his detriment – on what he believed to be the situation and what he was led to believe the situation is.
“I would have a tendency to rule in his favour because of that fact.”
Mr Galbally said whatever decision is made by the Federal Court will have wider ramifications.
“I think one of the big problems the court is going to have to face is if they make a decision in his favour, are they going to open the floodgates? Or are they able to word a judgement that is strictly restrictive to his particular circumstances,” he said.
