Neil Mitchell speaks with president of the Administrative Appeals Tribunal

The Administrative Appeals Tribunal has overturned Peter Dutton’s visa decisions 4389 times in the past year.

The Immigration Minister’s decision to boot a guilty sex offender out of the country was recently overturned, even after the Indian-national pleaded guilty to indecent assault.

Duncan Kerr, Federal Court judge and President of the Administrative Appeals Tribunal, spoke with Neil Mitchell about the statistics.

‘That does sound surprising to me,’ said Mr Kerr about the AAT’s 39 per cent rejection rate.

‘There may be a rare instance where a complete mistake has been made and the person hasn’t done anything bad at all.

‘But in most instances there would probably be evidence of some character default.

‘Part of the process is public scrutiny, we have to publish reasons and those reasons allow both the government or a person who’s disappointed by a decision that doesn’t go their way to take it further on an appeal.’
