Man has phone use fine overturned on legal technicality
A Queenslander who copped a hefty fine for using his phone while driving has had it overturned in court after it was deemed “not a mobile phone” because it couldn’t make calls.
And a lawyer says similar could happen in Victoria.
“If they want to avoid what’s happened in Queensland, they will need to change the legislation,” Justin Lawrence, partner with Henderson and Ball lawyers, told Ross and Russel.
