The Andrews Government has backed away from its election commitment to randomly breath-test judges and MPs.

The promise was made on the eve of the state election.

But legislation put to parliament covering the courts does not mention the term ‘breath-test’. Instead, it says a medical test can be requested if there is a concern.

Attorney General Martin Pakula says the legislation gives authorities broad powers to ensure the effective running of the courts.

But Neil Mitchell pointed out that that didn’t equate to a ‘random’ test, which is what was promised.

Mr Pakula: ‘We’re getting hung up on the world ‘random’ now are we?’ Neil: ‘Well, you’re the ones who said it!’

He said it proved that the government’s pre-election announcement was a ‘gimmick’, which ‘conned’ voters.

Mr Pakula, naturally, disagreed and they had a pretty good barney about it.
